No Dollars To Uyghur Forced Labor Act (H.R.4039)
The “No Dollars To Uyghur Forced Labor Act” (H.R.4039) was introduced on June 12, 2023 in the House by Congressman Nathaniel Moran (R-TX), along with 3 cosponsors. This bill prohibits any use of U.S. government funds for activities overseas that involve the procurement of goods or merchandise originating from the Xinjiang Uyghur Autonomous Region.
The bill:
- Mandates that funds available to the Department of State or the U.S. Agency for International Development (USAID) cannot be used for activities involving purchase of goods or merchandise produced in Xinjiang Uyghur Autonomous Region (XUAR).
- Provides that the Secretary of State may authorize activities involving purchase of goods from Xinjiang only if clear and convincing evidence demonstrates that they were not produced by forced labor. This authorization requires prior notification to specific Congressional committees and cannot be utilized if the Congress has expressly prohibited the activity through a joint resolution.
- Defines “forced labor” in alignment with the definition in Section 307 of the Tariff Act of 1930.
